1. Overview

3. Where to Submit a DMCA Notice

All DMCA Takedown Notices must be submitted in writing to our designated agent:

We strongly recommend submitting your notice via email to ensure the fastest possible response. Notices that do not include all required elements may not be acted upon.

4. ShopThePower’s Response to Valid Notices

Upon receipt of a complete and valid DMCA Takedown Notice, ShopThePower will:

1. Review the notice for completeness and validity
2. Promptly remove or disable access to the allegedly infringing content
3. Notify the user or party who posted the content, if applicable and identifiable
4. Document the notice in accordance with our record-keeping obligations under the DMCA

ShopThePower reserves the right to seek clarification before acting on a notice that appears incomplete or that raises questions of legitimacy.

5. DMCA Counter-Notice

If you believe that content on our website was removed or disabled as a result of a DMCA notice in error or due to misidentification, you may submit a Counter-Notice pursuant to 17 U.S.C. § 512(g)(3). Your counter-notice must include:

1. Identification of the removed content: A description of the content that was removed and the URL(s) where it appeared before removal
2. Your contact information: Your full legal name, mailing address, telephone number, and email address
3. Good-faith statement: A statement under penalty of perjury that you have a good-faith belief that the content was removed or disabled as a result of mistake or misidentification
4. Consent to jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if you are outside the United States, for any judicial district in which ShopThePower may be found
5. Signature: Your physical or electronic signature

Upon receipt of a valid counter-notice, ShopThePower will forward a copy to the original complainant and may restore the removed content after a waiting period of not less than 10 business days, unless the original complainant files a court action to restrain the restoration.

6. Repeat Infringer Policy

In accordance with the DMCA and in ShopThePower’s sole discretion, we reserve the right to terminate access to our website for users who are determined to be repeat infringers of intellectual property rights. A repeat infringer is a user who has been the subject of more than one valid DMCA takedown notice.

7. Limitation of Liability

ShopThePower’s compliance with the DMCA’s notice-and-takedown procedures is intended solely to qualify for the safe harbor protections provided under 17 U.S.C. § 512. Nothing in this policy constitutes an admission of liability or a waiver of any rights or defenses available to ShopThePower under applicable law.
